Terms of Use
These Terms of Use govern access to the public eTrepid website. By using the website, you agree to these terms. If you do not agree, do not use the website.
Informational purpose
The website provides general information about eTrepid, cybersecurity, governance, risk and compliance, CMMC readiness, government acquisition, managed services, AI governance, AI-as-a-System, and related subjects. Website content is not legal advice, an assessment result, a certification, a guarantee of compliance, a guarantee of security, a guarantee of contract eligibility, or a commitment that a particular service or outcome is available.
Requirements, contract clauses, program rules, technologies, threats, and authoritative guidance change. Visitors are responsible for evaluating current requirements and obtaining appropriate professional advice for their circumstances.
No relationship or binding offer
Use of the website, completion of a readiness check, submission of an inquiry, or participation in an initial consultation does not create a client, advisor, fiduciary, assessor, certification, teaming, reseller, subcontractor, or government-contractor relationship. eTrepid services, responsibilities, deliverables, service levels, security boundaries, prices, licensing, and outcomes are established only in an authorized written agreement.
Government contract vehicles, identifiers, business-status records, and capability descriptions do not constitute an agency endorsement, award guarantee, order-level scope determination, or representation that every service is available under every acquisition path.
CMMC and compliance boundaries
eTrepid may provide readiness, governance, implementation, managed operations, remediation, evidence, and related services within an agreed scope. Unless expressly stated in an authorized agreement and supported by current status, website content does not represent eTrepid as an assessment or certification body. Certification and assessment decisions are made by the authorized parties under the applicable program.
AI and partner boundaries
AI Governance and AI-as-a-System content describes methods for governing AI use, authority, data, models, integrations, actions, oversight, logging, and accountability. It does not transfer human accountability to an AI system or guarantee that any model, agent, platform, or configuration is error-free, suitable for every use, or compliant in every environment.
Where contracted, eTrepid may implement or support Auctoric AIBOS. Auctoric retains ownership of its platform, intellectual property, licensing, core security architecture, and roadmap. eTrepid’s and the client’s responsibilities are defined by the applicable agreements.
Acceptable use
You may not use the website to:
- violate law or another person’s rights;
- attempt unauthorized access, testing, disruption, scraping, or circumvention;
- introduce malicious code or interfere with website availability;
- misrepresent identity, affiliation, authority, status, or evidence;
- submit CUI, credentials, confidential architecture, vulnerability details, incident data, assessment workpapers, or other sensitive information through an unapproved public channel; or
- copy, modify, or use website content in a way that infringes intellectual-property rights or creates a misleading endorsement.
Authorized security research, testing, and disclosure require prior written permission and an approved scope.
Intellectual property
Unless otherwise indicated, the website and its original text, graphics, marks, design, and other content are owned by or licensed to eTrepid and are protected by applicable law. eTrepid, ThreatKrusher, Auctoric, AIBOS, third-party marks, and associated logos remain the property of their respective owners. No license is granted except the limited right to view and use the public website for lawful informational purposes.
External links
The website may link to government records, scheduling, client support, partner, social-media, and other third-party sites. External links are provided for convenience and context. eTrepid does not control third-party content, security, availability, terms, or privacy practices and does not endorse a third party merely by linking to it.
Availability and changes
eTrepid may change, suspend, restrict, correct, or remove website content or functionality without notice. We may correct factual, typographical, source, status, scope, or routing errors when identified.
Disclaimers and limitation
The website is provided on an “as available” basis to the extent permitted by law. eTrepid does not make warranties through the public website regarding uninterrupted availability, completeness, accuracy for a visitor’s specific circumstances, fitness for a particular purpose, or a particular compliance, security, acquisition, or business result.
To the extent permitted by law, eTrepid will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or reliance on the public website. Nothing in these terms excludes liability that cannot lawfully be excluded or modifies obligations established in an applicable written agreement.
Privacy
The Privacy Policy explains website-related information practices. Do not use public website channels for sensitive or controlled information.
Governing law and venue
Except where applicable law or a signed agreement requires otherwise, these Terms and disputes arising solely from use of the public website are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Any such dispute must be brought in a state or federal court with jurisdiction serving Charles County, Maryland, and each party consents to that forum and jurisdiction.
This website provision does not alter the governing law, venue, disputes process, sovereign rights, procurement rules, or other terms established by a client agreement, government contract, subcontract, partner agreement, or other signed instrument.
If any provision of these Terms is found unenforceable, the remaining provisions remain effective to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.
